The Trademark Battle between BigBasket & Daily Basket: An Economic Perspective

This article uses an economic perspective to examine the recent trademark dispute between BigBasket and Daily Basket, wherein BigBasket has accused Daily Basket of ‘Trademark Infringement’ whereas Daily Basket has accused BigBasket of ‘Trademark ‘Bullying’. It is argued that since a trademark is protected by the law because it gives an incentive to the producers to increase production and benefits consumers by reducing consumer search-costs, trademark bullying is antithetical to such economic and consumer centric-basis of trademark law.
